San Francisco’s Draft Wireless Ordinance Allows Hearings for Contested Public Right-of-Way Sites
San Francisco is currently drafting a wireless ordinance to regulate wireless facilities in its public rights-of-way, and the latest draft circulating calls for public hearings when a “Tier III” public right-of-way application is opposed.
Tier III are larger cell sites that could be further expanded, however, the draft breaks down Tier III sites into several categories, depending on whether they are within a scenic corridor of the city, or near a park or other protected area. Public hearings are required by the draft language if there is any objection to these cell sites.
Allowing for initial hearings of public right-of-way permit requests, if a timely protest is filed could be a way for Glendale to allow for citizen input without setting up a procedure for hearings in every single case.
